1. Data Controller
The data controller is the owner of Perygen Capital, based in Italy. For any matter concerning the processing of your personal data — including the exercise of the rights listed in section 6 below — you may write to office@perygencapital.com. Full identification details of the data controller are provided upon request or directly within any communication or contractual documentation shared with you.
2. Data we collect
Through the "Request Access" form we collect:
- Identification data: name, surname, country;
- Contact data: email, phone number;
- Investor profile and estimated investable capital range;
- Any information you voluntarily include in the free-text message.
When you browse the site we may automatically process technical data (IP address, browser type, pages viewed, timestamps) via server logs and, where you consent, via cookies. See our Cookie Policy.
3. Purposes and legal basis
- Handling your access request and pre-contractual communications — Art. 6(1)(b) GDPR (pre-contractual measures) and Art. 6(1)(a) GDPR (consent).
- Qualification as investor and confidential sharing of investment information — Art. 6(1)(b) and 6(1)(c) GDPR (compliance with applicable financial regulation).
- Security, fraud prevention and site operation — Art. 6(1)(f) GDPR (legitimate interest).
- Compliance with legal obligations (accounting, tax, anti-money laundering) — Art. 6(1)(c) GDPR.
4. Recipients and transfers
Personal data may be processed by authorised personnel and by external providers acting as data processors under Art. 28 GDPR (hosting, email, IT, legal and accounting advisors). Data is stored within the European Economic Area. Where transfer outside the EEA occurs, it takes place under appropriate safeguards (EU Standard Contractual Clauses).
5. Retention
Request-access data is retained for up to 24 months from the last contact, unless a contractual relationship is established, in which case data is retained for the duration of the relationship and for the further period required by law (typically 10 years for accounting and AML purposes).
6. Your rights
Under Articles 15–22 GDPR you have the right to access, rectify, erase, restrict or object to processing, receive your data in a portable format and withdraw consent at any time. You can exercise these rights by writing to office@perygencapital.com. You may also lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali, www.garanteprivacy.it).
7. Nature of the provision
Providing the requested data is necessary to evaluate your request; failure to provide it will make it impossible to respond. Data is not used for automated decision-making producing legal effects on you.
